Cartsy is a peer-to-peer marketplace that connects owners of street-legal golf carts (low-speed vehicles) with individuals seeking short-term, local transportation.

Cartsy:
* Does not own, operate, or maintain golf carts
* Does not provide vehicle insurance
* Does not act as a transportation provider
* Does not guarantee availability, condition, or legality of any cart

All rentals are agreements directly between owners and renters.

2. Eligibility

You must be at least 25 years old to use Cartsy.

By using the Platform, you represent that:
* You are legally capable of entering binding agreements
* You will comply with all applicable local, state, and federal laws

3. Owner Responsibilities

If you list a golf cart on Cartsy, you represent and agree that:
* Your cart is street-legal and compliant with applicable laws
* You maintain valid insurance appropriate for your cart
* You are the legal owner or authorized to rent the cart
* Your cart is in safe operating condition
* All information you provide is accurate and up to date

Owners are solely responsible for:
* Vehicle condition
* Maintenance
* Insurance
* Compliance with laws
* Any damages, claims, or liabilities arising from rentals

4. Renter Responsibilities

If you rent a cart through Cartsy, you agree to:
* Use the cart only for legal, local operation
* Follow all applicable traffic and safety laws
* Operate the cart responsibly and as instructed
* Return the cart in the agreed condition and timeframe

Renters are responsible for:
* Any fines, violations, or damage incurred during use
* Compliance with local regulations

5. Payments

Payments are processed through Stripe, a third-party payment provider.

Cartsy:
* Does not store your payment information
* Is not responsible for payment processing errors
* May collect platform fees

All fees are disclosed prior to booking.

6. Cancellations and Refunds

Cancellation and refund terms may vary by owner and booking.

Cartsy does not guarantee refunds and is not responsible for disputes between owners and renters. We may, at our discretion, assist in facilitating communication.

7. Insurance and Risk

Cartsy does not provide insurance for carts, renters, or owners.

By using the Platform, you acknowledge that:
* Operating or renting a golf cart carries inherent risk
* Cartsy is not responsible for accidents, injuries, or damages
* Owners and renters assume all risks associated with rentals

8. Limitation of Liability

To the maximum extent permitted by law:

Cartsy LLC shall not be liable for:
* Personal injury
* Property damage
* Losses or disputes arising from rentals
* Actions or omissions of owners or renters
* Indirect, incidental, or consequential damages

Our total liability, if any, shall not exceed the fees paid to Cartsy for the applicable transaction.

9. Indemnification

You agree to indemnify and hold harmless Cartsy LLC and its officers, members, and affiliates from any claims, damages, losses, or expenses arising from:
* Your use of the Platform
* Your violation of these Terms
* Your interaction with other users

10. Platform Availability

Cartsy is provided on an “as-is” and “as-available” basis.

We do not guarantee uninterrupted service and may modify or discontinue the Platform at any time.

11. Termination

We reserve the right to suspend or terminate access to the Platform at our discretion, including for violations of these Terms.

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles.
